I have always been drawn to the law and at one point considered applying to law school; however, as often happens, life took me in a different direction.  I was drawn to litigation involving large property damage and bodily injury claims in the transportation sector because it sits at the intersection of complex legal analysis, real-world impact and high-stakes advocacy.  Transportation incidents often involve multiple parties, significant damages and detailed regulatory frameworks, which make them both challenging and intellectually engaging. Working through that complexity to identify liability and build a strong case is something I find very rewarding.

Handling trucking transportation cases has become more complex in the claims arena in recent years.  I believe the most significant challenges include the rise of nuclear verdicts, increasingly complex digital evidence, expanded theories of corporate liability, pressure in the insurance market and the growth in litigation funding coupled with fraud. All these factors make transportation claims even more high-stakes and require a much more strategic, data-driven and proactive defense from the outset.

Coordinating Stakeholders for Stronger Case Outcomes

Both collaboration and communication are equally critical in effective claims management because multiple stakeholders – attorneys, claims professionals, insurers and experts – are involved in the ultimate resolution.  Clear communication ensures key evidence is gathered early, the case is strategically aligned and all parties understand the potential risks as well as exposure. Strong collaboration across these groups also helps streamline decision-making and positions the case for the most effective resolution.

Adapting to Rising Severity Across Transportation Insurance

The transportation insurance landscape is evolving in response to rising claim severity, with higher premiums, tighter underwriting standards and, in some cases, broader exclusions or carriers exiting the transportation market entirely. From a transportation carrier perspective, this environment is also forcing companies to adopt stronger safety and risk-management practices to control potential loss exposures.

Building the Judgment Behind Complex Claims Leadership

For today’s claims professionals looking to build expertise in the complex insurance claims and litigation management, it is important to develop a strong understanding of coverage issues, liability analysis — including state-specific applicable statutes — and litigation strategy.  Gaining exposure to different stages of a claim helps build the judgment needed to evaluate risk and manage high-severity cases effectively.

Another key piece of advice is to build strong relationships with defense counsel, experts and internal stakeholders.  Because complex claims require coordinated decision-making and clear communication, building these relationships is essential to ensuring everyone is on board with case planning, defense strategies and evidence management.

Finally, staying current on legal trends, regulatory challenges in relevant venues, and emerging risks in the transportation industry helps a claims professional anticipate challenges and make more informed strategic decisions in their cases.  Professionals should also make sure the attorneys they work with regularly keep them informed of legal updates, emerging trends in the commercial transportation industry, and political developments, including judicial appointments, that may influence litigation strategy.
